About these terms
These terms set out the basis on which SEND Guidance, a special educational needs and disabilities consultancy run by Claire Andrews, provides its services to parents, carers and schools. By booking a service or sending an enquiry, you agree to these terms. If you have any questions about them, please contact us at claire@sendguidance.co.uk before booking.
Our services
SEND Guidance provides information, guidance and practical support relating to special educational needs and disabilities, including Clarity Calls, EHCP reviews, annual review support, ongoing support and tribunal preparation support, as well as consultancy and training for schools. The specific service you receive will be the one you book and pay for, as described on this website at the time of booking.
What our services are and are not
Our services provide professional guidance, information and practical support drawn from extensive experience in education and special educational needs. They do not include legal advice or legal representation. We do not act as your solicitor or advocate before a tribunal, and nothing we provide should be taken as a substitute for advice from a qualified solicitor where legal advice is needed. Where formal legal support is appropriate, we will always say so and, where we can, point you towards suitable sources of help. The support we provide is intended to help you feel better informed and more prepared, but we cannot guarantee any particular outcome from a review, an assessment, a local authority decision or a tribunal, as these depend on many factors outside our control.
Booking and payment
Services are booked and paid for through this website. Payment is taken at the time of booking through our payment provider, Stripe. A booking is confirmed once payment has been received and you have received a confirmation email.
Cancellations and rescheduling
If you need to cancel or move a booked appointment, please let us know as far in advance as you can by emailing claire@sendguidance.co.uk. Where you cancel with reasonable notice, we will offer to rearrange your appointment or, where appropriate, provide a refund. We understand that family circumstances can change at short notice, and we will always try to be fair and flexible. If we ever need to cancel or rearrange an appointment, we will give you as much notice as possible and offer you an alternative time or a full refund.
Your responsibilities
So that we can give you the most useful guidance, we ask that you provide accurate and complete information about your situation, and that any documents you share, such as an EHCP, are ones you are entitled to share. The guidance we give is based on the information you provide, so its usefulness depends on that information being accurate.
Confidentiality
We treat the information you share with us, including information about your child, in confidence, and we handle your personal data in line with our privacy policy. We will not share your information with your school, your local authority or anyone else without your agreement, unless we are required to do so by law or where we reasonably believe someone is at risk of harm.
Our liability
We take care to provide our services professionally and to a high standard. To the extent permitted by law, we are not liable for any decisions you make, or outcomes that follow, based on the guidance we provide, as final decisions and their consequences rest with you and with the bodies responsible for your child's provision. Nothing in these terms limits our liability where it cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.
Intellectual property
Any written materials, templates or resources we provide to you remain our intellectual property and are provided for your own personal use in relation to your own situation. Please do not reproduce or share them for commercial purposes without our permission.
Changes to these terms
We may update these terms from time to time. The version that applies to you is the one published on this website at the time you book a service.
Governing law
These terms are governed by the law of England and Wales, and any disputes will be subject to the courts of England and Wales.
