EHCP draft checking: know what is missing before the plan is final
Independent checking of the draft EHC plan your local authority has sent you, with written feedback on what is missing and what is too vague to hold anyone to. If your plan is already final, that is reviewed the same way.
Before the plan is final
You have at least 15 days to comment on a draft plan
When the local authority sends you a draft EHC plan, it must give you at least 15 calendar days to respond, beginning with the day the draft is served on you. That is regulation 13(1)(a) of the Special Educational Needs and Disability Regulations 2014. In those 15 days you can say what is missing, ask for provision to be written more precisely, request a meeting with an officer, and ask for a particular school to be named.
That window is the most useful one you will get. Once the plan is finalised, changing it is slower and harder. Vague provision is the specific problem to look for. Wording like “regular support” or “access to” is very difficult to hold anyone to later, whereas a stated amount, delivered by a stated person, at a stated frequency, is not.
